Terms of Use

Welcome to FeedBackApp (“FeedBackApp”, “we”, “our”, or “us”). These Terms of Use (“Terms”) govern your access to and use of our website, applications, and services.

By creating an account, joining an event, uploading content, or otherwise using FeedBackApp, you agree to be bound by these Terms. If you do not agree, please do not use the service.

1. Description of the Service

FeedBackApp is a platform that enables speakers, presenters, moderators, event organizers, and participants to collect audience feedback, record audio, generate transcripts, identify action items, create summaries, and analyze engagement during presentations, meetings, workshops, and other events.

Features may evolve, be modified, or be discontinued as the service develops.

2. Eligibility

You must be at least 16 years old, or the minimum age required by applicable law in your jurisdiction, to use the service.

If you use FeedBackApp on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Accounts and Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activities that occur under your account.
  • Providing accurate and current account information.

You agree not to:

  • Share your account with unauthorized persons.
  • Impersonate another individual or organization.
  • Create accounts using false or misleading information.
  • Attempt to gain unauthorized access to other accounts, events, systems, or data.

We may suspend, restrict, or terminate accounts that violate these Terms or pose a security, legal, or operational risk.

4. User Content

You retain ownership of content you upload, record, transmit, submit, or create through FeedBackApp, including audio recordings, transcripts, presentations, documents, images, photographs, videos, profile pictures, event banners, comments, feedback data, and other event materials (“User Content”).

By using FeedBackApp, you grant us a limited, non-exclusive, worldwide license to host, process, store, analyze, reproduce, display, and transmit User Content solely for the purpose of operating, securing, maintaining, improving, and providing the service.

You are solely responsible for all User Content that you upload, publish, share, or make available through FeedBackApp.

You represent and warrant that:

  • You own the User Content, or have obtained all necessary rights, licenses, permissions, and authorizations required to upload and use it.
  • Your User Content does not infringe any copyright, trademark, patent, trade secret, privacy right, publicity right, or other legal right of any third party.
  • You have obtained any legally required consent from individuals appearing in photographs, videos, recordings, or other uploaded materials.
  • Your User Content complies with applicable laws and regulations.

You may upload images, photographs, graphics, videos, presentations, documents, logos, and other materials only if:

  • You own the content; or
  • You have obtained all necessary rights, licenses, permissions, or authorizations; or
  • The content is in the public domain or available under a license that permits your intended use.

You remain solely responsible for verifying that your use of any uploaded content is lawful.

If we receive a complaint, takedown request, court order, or reasonably believe that User Content violates these Terms or the rights of others, we may remove or restrict access to such content without prior notice.

FeedBackApp does not pre-screen or verify the legality, ownership, or accuracy of User Content uploaded by users.

5. Recording, Transcription, and Consent

FeedBackApp may record audio, generate transcripts, create summaries, identify action items, and perform AI-based analysis of conversations.

Event organizers, speakers, and account owners are solely responsible for ensuring compliance with applicable laws regarding:

  • Recording of conversations.
  • Participant notification.
  • Consent requirements.
  • Employment regulations.
  • Privacy and data protection laws.
  • Any industry-specific regulatory obligations.

FeedBackApp does not verify whether participants have been informed of or consented to recording or transcription activities.

The responsibility for obtaining any required permissions, notices, or legal authorizations rests entirely with the organizer, speaker, or account owner.

6. Respectful Conduct and Community Standards

FeedBackApp is intended to support productive communication, collaboration, learning, and constructive feedback.

We are all equal. Regardless of race, ethnicity, nationality, religion, disability, age, gender, gender identity, sexual orientation, political views, or any other personal characteristic, all users must be treated with dignity and respect.

We maintain a zero-tolerance policy for:

  • Harassment.
  • Bullying.
  • Hate speech.
  • Threats or intimidation.
  • Discrimination.
  • Personal attacks.
  • Abusive behavior.

Treat others the way you would like to be treated.

We reserve the right to remove content, restrict participation, suspend events, or terminate accounts that violate these standards.

7. Prohibited Content and Activities

You may not use FeedBackApp to create, host, promote, distribute, upload, stream, or share content related to:

  • Illegal activities.
  • Copyright infringement or pirated material.
  • Fraudulent, deceptive, or intentionally misleading information.
  • Malware, viruses, spyware, ransomware, or malicious software.
  • Hacks, cheats, exploits, cracking tools, or unauthorized access tools.
  • Counterfeit, stolen, or fraudulent goods or services.
  • Stolen financial, banking, or payment information.
  • Unauthorized software licenses, activation keys, serial numbers, or account credentials.
  • Illegal drugs or controlled substances.
  • Ponzi schemes, pyramid schemes, pump-and-dump schemes, or similar fraudulent financial activities.
  • Violence, terrorism, criminal activity, or exploitation of others.
  • Content that infringes intellectual property, privacy, publicity, or other legal rights.
  • Copyright-infringing images, photographs, videos, music, presentations, documents, logos, trademarks, or other protected materials.
  • Images, recordings, or personal information of individuals where required permissions or legal rights have not been obtained.
  • Content that violates privacy, publicity, personality, or image rights.
  • Content falsely claiming ownership of intellectual property belonging to another person or organization.

You may not:

  • Circumvent access controls or event permissions.
  • Scrape or harvest user data without authorization.
  • Reverse engineer, overload, disrupt, or interfere with the service.
  • Use automated systems to abuse or degrade the platform.
  • Attempt to gain unauthorized access to systems, accounts, or events.

FeedBackApp may remove content or suspend accounts without prior notice where necessary to protect users, the platform, or comply with legal obligations.

8. User Names, Profiles, and Event Information

User names, profile information, profile pictures, event titles, and event descriptions must be appropriate for a professional and respectful environment.

We may require users to modify or remove content that we reasonably determine:

  • Is offensive, hateful, discriminatory, or abusive.
  • Impersonates another person or organization.
  • Promotes illegal activities.
  • Is deceptive or misleading.
  • Violates these Terms.

Failure to comply may result in account restrictions, event removal, or account suspension.

9. AI-Generated Content and Transcriptions

FeedBackApp may use speech recognition, artificial intelligence, and machine learning technologies to generate transcripts, summaries, action items, analytics, recommendations, or insights.

These outputs are generated automatically and may contain inaccuracies, omissions, misinterpretations, or errors.

You are responsible for reviewing and validating all AI-generated content before relying on it for business, legal, regulatory, medical, financial, academic, employment, or other important decisions.

FeedBackApp does not guarantee the accuracy, completeness, or suitability of AI-generated outputs.

10. Intellectual Property

FeedBackApp and its software, source code, designs, trademarks, logos, documentation, and technology are owned by us or our licensors and are protected by applicable intellectual property laws.

Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, lease, sublicense, or create derivative works based on the service.

11. Service Availability

We strive to provide reliable service but cannot guarantee uninterrupted availability.

The service may occasionally be unavailable due to:

  • Maintenance.
  • Upgrades.
  • Security incidents.
  • Third-party outages.
  • Infrastructure failures.
  • Circumstances beyond our reasonable control.

We may modify, suspend, or discontinue features at any time.

12. Fees and Subscriptions

Certain features may require payment.

Where paid plans are offered:

  • Pricing will be disclosed before purchase.
  • Fees are generally non-refundable unless required by law.
  • We may modify pricing with reasonable notice.

13. Termination

You may stop using FeedBackApp at any time.

You may delete any event you own, or your entire account, at any time. Deleting an event permanently erases it along with all associated data, including audience reactions, notes, and transcripts recorded during that event. Deleting your account permanently erases the events you created (and their associated audience data), your uploaded images, your shop links, and your follow relationships in both directions. Deletion is immediate and irreversible.

We may suspend, restrict, or terminate access if:

  • You violate these Terms.
  • We are required to do so by law.
  • Your use creates legal, operational, or security risks.
  • Your conduct negatively affects other users or the platform.

Termination does not affect rights or obligations accrued prior to termination.

14. Disclaimer of Warranties

FeedBackApp is provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of:

  • Merchantability.
  • Fitness for a particular purpose.
  • Non-infringement.
  • Accuracy.
  • Availability.
  • Reliability.

We do not guarantee that:

  • The service will be uninterrupted.
  • The service will be error-free.
  • Transcriptions will be accurate.
  • AI-generated outputs will be correct.
  • The service will meet your specific needs.

15. Limitation of Liability

To the fullest extent permitted by law, FeedBackApp and its operators shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, revenue, business opportunities, goodwill, reputation, or data.

Our total liability arising from or relating to the service shall not exceed:

  • The amount paid by you to FeedBackApp during the twelve (12) months preceding the claim; or
  • EUR 100 if you have not paid any fees.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

16. Indemnification

You agree to indemnify and hold harmless FeedBackApp, its operators, affiliates, contractors, employees, and service providers from claims, damages, liabilities, losses, and expenses arising from:

  • Your use of the service.
  • Your User Content.
  • Your events.
  • Your violation of these Terms.
  • Your violation of applicable laws or third-party rights.

17. Privacy

Your use of FeedBackApp is also governed by our Privacy Policy, which explains how personal data is collected, processed, stored, and protected.

18. Changes to These Terms

We may update these Terms from time to time.

Material changes will be communicated through the website, application, email, or other reasonable means.

Continued use of the service after revised Terms become effective constitutes acceptance of those Terms.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding conflict-of-law principles.

If you are a consumer residing in the European Union, mandatory consumer protection rights under applicable law remain unaffected.
